Sean and Alisha were hanging out by the lake in prospect park when Alisha said to Sean, I will give you my car if you swim against this lake. Sean replied, ''o.k.,''jumped in and started swimming to the other side. ''hey,'' screamed Alisha, I'm kidding! Sean continued swimming and made it across to the other side. Alisha refused to turn over her car. If Sean takes it to court will he win?

Only if the car is worth less than $1000. Pursuant to the Statute of Frauds, a contract for an item worth more than $!000 must have a writing signed by the party to be charged.
