Legal Question in Bankruptcy in New York

Laws regarding inheritance after filling chater 7bankruptcy.

One is required to report any inheritance for 6 months after receiving a discarge of a chapter 7 case... is this correct and does it refer to the date the discharge is granted or, to the date the closure is granted, on that case? Thank you for your time.

Re: Laws regarding inheritance after filling chater 7bankruptcy.

Now this is the kind of question you should ask a lawyer. How to count the number of days specified in a law is a question lawyers argue about every day. In the Bankruptcy Code this question is answered by section 541(a)(5)(A).

The answer given is not six months, but rather 180 days from the date the bankruptcy petition is filed.

This not the date of the confirmation, closure, 361 meeting, or other event. The 180 days are counted from the day the petition is given to the court with your 200 dollars. It is the date that you filed with the court. You are welcome to a consultation for no fee at my offices at 42 West 44th St. Ny NY. Please call for an appointment first (646) 591-5786.
