You should always proceed with an attorney on such matters to circumvent similar problems. It will cost you multiple times more to retain an attorney now and enforce your rights than having had hired one before you proceeded with your idea. Furthermore, your having paid a fee upfront is a travesty. However, you have certainly signed a contract with a company that is many times more aware of its contents than you are. It is even worse if you do not have a contract. Did you sign anything? Are you willing to spend thousands more to retain an attorney to enforce your rights?

As a Franchise Attorney I agree entirely with the other attorney answer. You don't just market an idea. You should have taken all steps to legally protect the idea before any marking takes place. You really need to consult with a good business or franchise attorney in your area for specific advice as soon as possible.
