Legal Question in Business Law in New York

Responsibility of Hospitals in forming contracts

I was hospitalized having passed out with severe abdominal pain and was placed in an intensive care unit. My doctor told the hospital personnel to order round-the-clock nursing care for me. At the hospitals request, a nursing services firm, provided two weeks of at-home care. During the at-home period of care, I was fully aware that I was receiving the benefit of the care services. The nursing home d later billed me $1500 for the nursing care but I refused to pay claiming that she had not contracted the services either orally or in writing. In view of the fact that no express contract was ever formed, can the nurisng home egally recover the $1500 from me?

Re: Responsibility of Hospitals in forming contracts

Yes. You knew they were not volunteering the services and you accepted their benefit. If you beleive the charges are excessive you can ask for an accounting of the rate but arguing that you don't owe because there was no contract is a losing proposition.
