Legal Question in Civil Rights Law in New York

Civil Rights Violation

I tried to report an assault over the weekend. The officer would not take my report. I asked why not. He said he didn't feel like it and then told me that I was standing on his sidewalk. I asked for his name because his badge was not visible. At that point he told me if I didn't leave his sidewalk he would arrest me. I started walking away. After about twenty feet I said I just don't understand why you won't give me your name. At this point I was arrested. When I asked what I was being arrested for I was told that it was because the officer didn't like me. I was taken to the police station. I repeatedly asked to contact a lawyer. I was told I could use a specific phone, which was non-working. I was held overnight and in the morning I was told I was being charged with disorderly conduct. I plead not guilty. What should I do?

Re: Civil Rights Violation

HIRE A LAWYER NOW!!! You have a pretty good shot here. Especially if you have a witness to any of this. Do not handle any of this alone, you could injure your ability to collect from one or more of the entities involvd.

Good Luck.

Re: Civil Rights Violation

It sounds as though you may have an action against the municpality that employs the officer, and the officer for a violation of 42 USC 1983, forviolating your rights under color of law. If you wish to discuss this further, contact my office for an appointment.
