Conspiracy

My girlfriend has won a divorce from her husband of 28 yrs for cruel and inhuman. When she first filed for divorce in Oct.2000, she did not have an order of protection against, she was able to get one in Feb. 2001 which removed him for one year from the apartment for harassment. I have know them for about 30 yrs and found it hard to believe he did the things she said he did, being that he worked 10-12 hrs days and worked weekends constantly and she worked nights. However, she heard thru the grapevine that he plans to sue her and the childrens godfather for conspiring to tell the court system that he was a threat to her so as to have him removed from the apartment. She said he claims he has proof. I told her that if he did have proof them it is too late to use it and that he cannot sue them now for conspiracy. I am right, am I?

If she committed perjury, and conspired with another person or persons, to have have husband removed from the home on a bogus Order of Protection, then she committed a felony.

If he can prove this, or the DA can, then your friend has reason to be concerned. Suggest she consult with an attorney now.
