Legal Question in Civil Rights Law in New York

depositions

Is there any way to get the Judge in a case to read both parties depositions, sworn testimony, and there by removing the need for a trial. Having him render a decision just based on the sworn testimony of the depositions?

Re: depositions

NO! your closest bet is to file a motion for summary judgment, and include in that motion all arguments based on the issue within the depositions -

there would have to be some information there that would clearly indicate who should be the outright winner - there usually is not - and most trials tend to be JURY trials, so they are the ultimate decider of fact, as opposed ot the judge...

much luck
