Legal Question in Civil Rights Law in New York

My nephew is 5yrs old and autistic he currently goes to a school for autistic children and is doing well but his school district want to put him in regular school inside a special ed class but we were advised from his pediatrician and nuerologist that they recommend he go to boces witch is a school only for kids with special needs due to the severity of his disability the school has ignored our request and denied an advocate for him what legal standing do we have to get my nephew the education and services he needs....

The parents of the child can take legal action to compel the school board to assign your nephew to the school recommended after a review by his therapist/psychologist and the formation of an education plan.
