Public education in New York State

My 10 year old daughter had a

difficult

school year with a bully in her class.

She complained as did I but nothing

was done. In June the boy twisted

her arm sending her to the hospital.

Still nothing done. I just got the new

class list for fall 2008 and the boy is

in her class. I spoke to the Principal

and Supt who received a copy of a

police incident report and Emergency

room report and I asked for my child

to be placed in another class for the

fall but they wont grant any changes

because in the past so many parents

requested changes, even though my

cause is real and serious. I need a

letter from a Lawyer asking for my

child to be safe in her class and in her

school district Hastings on Hudson NY

Your situation brings up a couple of things to consider. A letter from an attorney can definitely encourage the principal and the school to act. However, they may still refuse to transfer your daughter. You should also consider that the June incident with your daughter may allow you to bring a lawsuit against the school on her behalf for failing to protect her from the bully.
