Legal Question in Civil Rights Law in New York

violation by attorney

I bought a house 3 years ago. the house had some code violations at that time, like a finished basement with a bath room and the previous owners converted the garage to a den. I told all these things to my attorney but he did nothing. now i am in court for violation of all these things and my attorney states that he told me about those violations and i refused to get the permit because of higher taxes. my attorney is lying, but how could i prove it? the burden of proof belongs to who? is there any chance i could get a fair deal.

You will probably have to pay the fines. You should be able to file an original action against your attorney for malpractice. However, be FOREWARNED: check and double check all of your closing documents for any disclosure on the items you described before proceeding any further.
