Legal Question in Civil Rights Law in New York

Violation of privacy

A newspaper blog just published my email address, and dozens of others, by ''sharing'' an error made by a government agency, in which the agency sent out an email using cc: instead of bcc: to all those seeking employment with a new administration.

I'm outraged! They have invaded my privacy, published my email address without my permission, and have subjected me to the inevitable flood of spam, as well as causing my employment prospects harm.

Can I/we sue the newspaper or its blogger/columnist?

Re: Violation of privacy

Probably not, unless they violated some court order or violated their own stated policy somehow. It's a tough case to make as the newspaper is likely protected by the First Amendment.

Should you like to discuss this or any other legal matter, you can e-mail me for more information about low cost face-to-face, on-line, or a telephone consultation with a lawyer in our office.

Re: Violation of privacy

I don't believe so. If it was a newspaper

reporting a so called "public interest story" you face all the first amendment protection that entails. Since your address was not private in the first place, reporting the error would not have caused any damages that didn't already exist.
