Bank account holds

in nov 2005 i began receiving phone calls about an old credit card debt from a collection co. i believe i paid the debt off through another collection co but don't have the old records as the last date of payment on my credit report is 2002. in may 2003 the debt was charged off and bought by the current co i think. i told the processor i had paid the debt off. they kept making calls which i avoided. on 5/19/06 Ifound out they froze my checking and saving accts. can they take my money without serving me with some type of legal papers and what recourse do i have if i don't have proof of paying off the old debt?

There is a procedure whereby they can take such action, but it should be used only in exceptional circumstances.

The bank records that show your payments can be unearthed through the financial institutions.
