how do I file a motion to dismiss a judgement & how do I get it removed off my credit report?

In New York, if you were not served properly and you have a meritorious (good) defense to the action itself then you most likely need to file an Order to Show Cause. If successful, the judgment will be vacated and most likely the case will be restored to the calendar giving you an opportunity to defend yourself. If you win that case you will have a winning judgment to show the credit bureaus. If you settle the case you can try to use the satisfaction of judgment (given after settlement is paid) but there is no guarantee that will be sufficient to remove the item from your credit report. The court clerk at the location where you were sued can help you with the order to show cause or you can call a lawyer to help. Please call if you would like to discuss further.
