Legal Question in Credit and Debt Law in New York

Small claim for money owed

I owed my ex husband money from years ago. We agreed he would keep child support till the money is paid. After 2 years he hasn't given me the support back. He claims I still owe him and is saying he will take me small claims court. How can I protect myself? If he sues me, can my current husband, who wasn't with me--name removed--the time I borrowed the money, be liable to pay it back?

Re: Small claim for money owed

You need to take him to fam court for either a court order for CS or to enforce any CS order you may already have.

Let him take you to small claims court as one has nothing to do with the other. And your new husband is not responsible for the debt.
