Legal Question in Criminal Law in New York

Assault on a Minor

I am a 16 year-old college student in New York. I was recently assaulted by a 31 year-old married man. The problem is, I was drinking alcohol at the time, and if I were to get caught, I'd lose my scholarship. My question is: Is there anyway of achieving any type of justice without me being at fault?

P.S. - He was serving me alcohol at his restaurant.

You can press criminal charges and/or you can sue for damages is there are any injuries that warrant it (assuming he has assets to collect). Why do you presume you will be dropped from your scholarship just for drinking, especially if you wer put in this situation by someone with direct intent to cause you phyiscal harm.
