Legal Question in Criminal Law in New York

Do I have a case? My sister and I were pulled over and told to get out of the car. We were both told to walk backwards in the direction of the police vehicles while guns, larger than the standard issue weapons were drawn. When I was told to turn around, an officer said that I was not the person they were looking for (my brother). There is at least a twenty year difference between us and facial features that make it more than obvious we are not twins. I was then hancuffed (by the same arresting officer from a previous charge which time has already been served), searched and placed in the back seat of a police car for at least 30 minutes.

Do you mean do you have a case against the city? Well that would be a civil case and the answer to that might be found by posting this on the civil litigation section of Law Guru. The police do have a right to stop based on suspicion. Also if there was an open warrant in the system they could take you in. The question would be should there have been an open warrant if, as you say, the case had been completed. That would be the element upon which a civil attorney would bring a case possibly.
