Legal Question in Criminal Law in New York

My 13 yr old son and his friend were skateboarding behind an abandoned building and decided to set a bon fire while doing so. when they left they stomped out the fire and walked away. A couple of hours later I had a police officer call me to tell me that the fire re-started because of how windy it was but that it shouldnt be a problem because it was an accident and the building was abandoned and falling apart anyway. Now I am getting a call stating that they are pressing charges and looking to get over 3000.00 in damages..--name removed--

in addition they have excavated and destroyed the entire back of the buiding so that you cant see what the actual damage was--name removed--which I was told was almost nothing initially--name removed--Is this legal? Is there anything I should to protect my son?

You should really retain an attorney right away, and do not let your son answer any questions until you do get a lawyer.
