Legal Question in Criminal Law in New York

how can this happen?

How can a person be arrested for second degree murder if four five witnesses, who have not been question in any way shape or form, can vouch for this persons wareabouts. There is three alleged witnesses whom all stand to gain from lying on this one person whom they all are friends. All three alleged witnesses having pending cases in the court on law. Why haven't the DA or PD question the witnesses who were with the person at the time of the crime.

It is quite common for someone who is arrested to give the names of people they are with at the time of the crime. The police will not always investigate these claims. The best course of action would be to retain a criminal defense attorney ASAP and provide the defense attorney with all of the information pertaining to these witnesses. Clearly with charges of this nature time is essential. The person who was arrested should make no statements to the police or anyone else until they have had time to meet with their attorney and talk it over. A mistake made early on in the process can significantly impair an attorney's ability to represent the arrested person later on. I would not have these witnesses contact the prosecutor or police until the person who was arrested has spoken with their legal counsel to see if this is the best way to proceed. Shoddy police work happens all the time. It is up to you and the friends of the defendant or accused person to stop it from happening to him.

He needs a lawyer who will fight for him, investigate the matter and knows how to beat the cops at their own games. It is not easy nor is it cheap. Expect the cost to be at least 6 figures if it goes to trial.

generally, the police only look at the witnesses for the crime... and they dont generally get too involved in the alibi's or backgrounds of these witnesses, it's usually up to the defense to do this.
