Legal Question in DUI Law in New York

backround check by prospective employer

do I need to reveal a DUI arrest and subsequent 6-month licence suspension that I had 26 years ago on a job application? Is this information available on a backround check? I have had no other contact with the law since except 1 speeding ticket that was reduced.

That depends on the info the application is asking. Typically prior arrests stay on one's history even if the record was sealed. It is better to err on the side of caution if the employer wants to know about arrests as opposed to convictions. At least with it being so long ago you can explain and/or get a certificate of disposition from court as proof.

26 years is a long time. Be honest about it, and about how much you have "grown up" and changed in that time. Better that than to lose the job because you have displayed a willingness to be dishonest.

Speeding tickets are violations and do not appear in your criminal record.
