Legal Question in DUI Law in New York

dui and speeding charges, 17yo w/ junior dl

I flipped my car the other night driving drunk after losing control avoiding a deer in the rain. The car went off the road and was totalled. There were no passengers, no others involved and no property damage except for a couple of small downed trees. The officer took a blood sample at the hospital while my father was not present even though he had wanted to refuse it. The accident happened when I wasn't supposed to be driving since I only have my junior dl. I've been charged with speeding (the officer said it only has to appear that I was driving over the limit during ''extreme conditions'') and for intoxication. I'm currently seeking representation but I'm trying to clarify what I can expect from this case.

Among other things, any of the following are possible:

Suspension Pending Prosecution/A Conditional License/A 20-Day Order/A License Suspension or Revocation/Time with a Victim Impact Panel

It also matters whether it is a DWI or DWAI.

If you are under 19 and you are convicted of DWI or DWAI Drugs, you MAY be eligible for youthful offender treatment. This is no guarantee at all

of any of this. Much also depends on where you got the ticket..Westchester or Putnam or Dutchess.

You may face jail time on such a charge, however this is not the only potentiality. You may also face other penalties such as fines and/or probation.

A good attornet may be able to reduce the charges and/or get them dismissed depending on the situation, andensure that there is no permanent record as a result of this case for you.
