Legal Question in DUI Law in New York

Ny dwi

My son,19,was arrested for DWI. His B/A was 1.8. He has not been sentenced yet & was given a conditional license,sent to TASK & put in an alcohal rehab program. We are now (this month) moving to New Jersey (long time planned move). Can he obtain a conditional license in New Jersey? Can he drive in New Jersey with a NY conditional license? Can he attend a NJ rehab program that would satisfy NY requirements? His next court date in NY is December 13.

Hi, sorry your son is having so much trouble.

1. As for a conditional license in NJ probably no but you can check with NJ DMV.

2. He can drive in NJ with a NY conditional license but again check with NJ DMV.

3. If it is ok with the court, it is ok to do rehab in NJ. NY just switched over to OASAS approved therapy programs. I do not know if NJ has any such animal. Best to speak to your TASC counselor about it.

Sorry but a lot of this is dependant on a bunch of things. Most of them are out of your control. The best thing to do is get your son out of the court system as soon as possible. Have him complete all requirements ASAP and then ask your lawyer to move up the sentencing.
