Legal Question in DUI Law in New York

Possession of alcohol by minor

Im 18, never had a summon about underage drinking. At a late night birthday party in a karaoke place. around 1:30 AM, police arrived and ask for IDs. No question asked or test done. Around 10-15 people received an summon for underage drinking. But i did not drink, i was drinking orange juice and eating birthday cake. On my summon, they did not mention the fine i need to pay, only asked to show up for court. What will happen? Will this be in my record? What should i do to pervent any negative outcome? Thanks alot!!

what you were given is a DAT (Desk Appearance Ticket). It is an option the police have, in lesser crimes and violations, instead of arresting an individual. You will show up in COurt on that that and appear in fron of a judge and be arraigned. A Legal Aid attorney will be provided to you,unless you chose to hire your own, and you will more than likely be given an offer to plead guilty to then and there, or they may move to dismiss the case.

THings you would want to focus on were wether you were throwing the party or not, who was throwing the party, was there a bartender, and what evidence was there of you drinking alcohol. If there is any lack in evidence, your lawyer should move to dismiss and you may be done with the whole thing there...
