Legal Question in Education Law in New York

Physical / Emotional Abuse @ H.S.

My child has been assaulted, verbally abused, followed and videotaped by someone in school. I have had it with talking to administrators; they allow this kid to continue without punishment at all. It now appears this kid is pulling others in to also menace, harrass and threaten my child and make false claims against my child in order to keep the trouble ongoing. I am working with advocates and police to file reports. I am wondering about legal help, as this is out of control. My child has broken no school rules or laws. The school is not notifying the in-house officer when laws have been broken. Thank you for any help in this frustrating situation.

You most definitely need to get to a lawyer. Often the school is afraid that if they call the police they will face a false claim charge. If you want to make an educator do anything, get a lawyer. They are afraid of us (and rightly so).

The fact that your child is being bullied means that there may be harassment charges and your child may be entitled to stay away orders that if ignored could wind up putting these kids into a juvi detention center.

A good lawyer will force the school to do something. I hope you are able to get to one soon.
