Website- copyrighted material

I'm building a website with free downloadable ORIGINAL content. Is there a way I can incorporate copyrighted material for promotional use? What if said material is uploaded from other users after agreeing to a terms of use statement?

If you mean a third party's material, the answer is not without consent, a fair use argument or some other favorable position that a lawyer might advise. I don't understand your question otherwise.

You would need the owner's permission to use copyrighted material, unless you qualify for some other exception under the law.
