Legal Question in Environmental Law in New York

Illegal Ponding

A neighbor's pool is leaking hundreds of gallons of water a day, which has flooded my yard. The neighbor has been made aware of the problem and refuses to make any remedy. Is there a statute regarding illegal ponding or the flooding of my property?

Re: Illegal Ponding

There is no state statute that specifically addresses leaky swimming pools. There may be a town or village ordinance. More to the point, a pool that floods your property is a legal nuisance, and you can sue to abate it...potentially including filling the pool with soil and foreclosing a lien on the neighbor's property for the cost of the abatement.
