Legal Question in Family Law in New York

An affair 10 years ago in NY is now a support case.

i was in ny for three years 91-93 and had an affair, both of us married to others, she told me she was pregnant months before i left and i replied that i was not infavor of being a father to a child i would not be around. i requested early termination, her reply was i would not be held responsible for her decision. i last saw this person in 1993 and now she wants me to pay child support. i don't know if the child is really mine but she entered my name on his birth cert and gave him my surname without my consent. does this affair have to cost my marriage and support? she has told me i will get summons shortly how must this be legally served to be valid because she is not trusted by me and may try to fool me. i reside in texas since 93 and this person resides in ny. what should i expect or do at this time.

There is nothing you can do until you are actually served. AFter you are served, you can ask the court to establish paternity.

You should find a good family lawyer in New York in the county where she and the child reside. It may be possible for that lawyer to file papers so that you need not be served. If the child is yours, and blood tests should determine that, I would be prepared to pay child support. In Texas, that is normally determined by how much money you make.

You can request a paternity test, however it is determined that you are the father, you will be responsible to pay child support and can be arrested as well as have wages garnished or assets you own attached to pay for support if you fail to do so.
