Legal Question in Family Law in New York

Child Custody - Vacation

We are trying to plan a family vacation with my daughter. My ex-wife and I have joint custody, she has physical residency. I have four weeks with my daughter in the summer months according to the court order. I recently informed my ex-wife that I am planning to take my daughter to Disneyland in June, and she said that Icannot take Nicole out of the State of New York for a vacation. The agreement doesnt say this anywhere, what are my options?

Re: Child Custody - Vacation

I assume there is a Family Court Order of Custody & Visitation. That order should indicate whether vacations out of the state are prohibited. If it does not then there is no reason why you are not allowed to take your daughter to Disneyland. If she insists, then you can always file a Modification Petition.
