Legal Question in Family Law in New York

Child Custody Violations

I am about to take my ex to court for violations to our child custody agreement. I am a pro se petitioner as I cannot afford an attorney. Since the filing of my petition, my ex has blatantly violated additional sections of our custody agreement, that were not noted in the original petition. Do I need to file additional petitions? Or will I be allowed to discuss these additional violations at the time of our initial court appearance.

Thank you in advance!

Re: Child Custody Violations

Although you cannot afford an attorney to represent you, suggest you consult with an experienced matrimonial attorney.

Before I could give you any advice, I would have to see the Judgment of Divorce, and the Stipulation of Settlement.

I would also need to see the petition and discuss the new allegations, etc.

Once you establish a consultation relationship with an attorney, you may be able to receive ongoing legal advice even though the attorney is not appearing in court for you.

FYI - The court has the power to award you counsel fees, to be paid by your ex.

I practice in NYC & Long Island.
