child support

My childrens father is incarcarated, I married and now I was told that I have to sue my soon to be ex for child support even though he is not the childrens father. Is this correct?

If he did not adopt the children, he is not responsible. However if the children were born during the course of the marriage, there is a presumption that the husband is the father of the child.
