Legal Question in Family Law in New York

child support

I'm divorsed for 12 years. I've been paying child suppor until my son reached the age of 18. He will start colledge this fall. My x-wife is asking me to pay for his college now. I'm hardly making ends meet, although my x-wife makes a good living and earns several times more than what I make. I live in New York. My x-wife and my son live in New Jersey. What is my responsibility and can I avoid paying for college. If my son lived with me he would qualify for financial aid, but due to my x's high income he does not. Please advise what are my obligations and am I responcible for partial payment for college.

it all depends on what is in the stipulation of settlement or judgement from your divorce. If there is no clause on college you are not responsible to pay for his college expenses. as for child support, you must read the section on child support from your divorce papers. today, most child support is until 21 or 22 if in school. check before you stop paying or you could be in big trouble.
