Legal Question in Family Law in New York

Child support law

I have a 3 year old with a man who has 4 other kids with 4 women. I'm not getting child support (haven't filed). I think 1 of the moms is getting most of the support. Can I file to get an equal share, without having the father lose all of his money? I don't want him penalized because 1 mom is greedy. Also, I am in NY, but he is in CA. The other moms are in MS, Il, and CA - quite complicated. The mom getting most of the support $$ is in Mississippi.

Re: Child support law

Hi:

You can file for support but based on the info you have recited I am not sure how successful you will be, especially since your ex is out of state. If you file you probably will get an order, but collection will be difficult, until he is picked up on some unrelated charge. Good Luck

Re: Child support law

In NYS the income that will be determined will be reduced by the orders issued by courts before yours. So if there are outstanding orders, then you will get 17% of what is remaining once the those amounts are deducted. So if there are four other orders, then your order will probably be a lot less than the others.
