Child Support

My son turned 21 in November and I paid support until then, last week I found out he joined the military at the age of 19 and his mother never notified the court is there a way to recoup this since we were in court last year and she said he lived at home with her. We have been estranged (my son and I ) for 10 yrs.

I your child support obligation was originally started from a stipulation of settlement in a divorce, the terms fo that agreement are controlling. If your obligation started from a court order (Family Court) then you should look over the original order. You should consult an atorney in your area experienced with child support cases and family court.

I would consider both recouping the child support paid and discussing bringing an action against the mother of your son since what she did in making false statements in court is a crime in some cases. Have someone order the transcript of the court hearing.

This really depends on the language of the settlment agreement.

Depending on the amount of support paid it may be worth your seeking counsel to see if an action can be commenced to recoup the two years of support.
