Legal Question in Family Law in New York

hello, i am a mother to a 3 yr old. his dad and i are not married but we have lived very close to each other for 3 yrs. he has supported me with housing and money. we are now living apart but he is paying for my rent. things have been bad with is arguing and he says he can not pay anymore b/c he has no job. i want to move away into a cheaper place and just get away from him. my son loves him. i said that we should go top court to figure things out but he said no. what should we do without getting legal. would he have to give me money if he has supported me and i owe him money. should we try to figure out a custody sched on our own. all my friends are telling me to go to court but i dont want to do that to him. is there a less harsh way to figure this out. would the court order him to pay money even if he has no job and is having a really hard time? can i just move away with my son. does he have rights? could i get into trouble with the law if i just moved. what are my legal rights as the mother. do they take into consideration if i owe him money from all the years that he paid for the rent. i just dont know what to do. i want to work things out without getting legal. thanks

If you cannot come to an agreement on your own then you should listen to your friends and make application to Family Court for child support, custody and a visitation schedule.
