divorce

my husband has lived overseas since 2003 i have been commuting back and forth. We both agree its not working anymore and i would like to get a divorce with minimal cost. we have no children and he has no green card.

For New York to have jurisdiction for the divorce, the parties must comply with the jurisdiction requirement of NY DRL 230. In particular,

"1. The parties were married in the state and either party is a resident thereof when the action is commenced and has been a resident for a continuous period of one year immediately preceding, or

2. The parties have resided in this state as husband and wife and either party is a resident thereof when the action is commenced and has been a resident for a continuous period of one year immediately preceding, or

3. The cause occurred in the state and either party has been a resident thereof for a continuous period of at least one year immediately preceding the commencement of the action, or

4. The cause occurred in the state and both parties are residents thereof at the time of the commencement of the action, or

5. Either party has been a resident of the state for a continuous period of at least two years immediately preceding the commencement of the action."

If you have residence in New York for the past year, and comply with one of the five criteria, you would be able to commence a divorce action in New York.

If all parties consent to the divorce, it is deemed uncontested. If you are interested, my office charges a flat fee for an uncontested divorce.

First you have to show that you have grounds to file for a divorce in New York, depending on where you were married, where you live, etc.

If you qualify to file for a divorce in New York, and your husband does not objet to get divorce then you can file for uncontested divorce.
