Divorce in New york

I have been married for 8 years to a woman from Trinidad. We were married in Trinidad & Tabago and want to divorce. One child 8 years old. Can I just get New york Divorce papers online and file for divorce? My wife lives in new york for 3 years and we have been seperated for 3 years. Do I have to pay child support to the court or can I make arangements to pay My wife directly for child support. I have a previous child support order from california from a previous wife for 2 children?

Please advise what forms I need to secure and how to file

You can file for divorce in NY based on your wife's residency there (county where she resides). You can get uncontested div forms on-line BUT someone has to admit to one of the grounds for divorce (fault). You can include a written agreement (stipulation) to child support in the packet. You do not have to pay it to the court unless she files it w/ child support collection unit. If you are not in NY you will prob need an atty to file papers and arrange for service of process unless she is willing to assist/waive service.
