Legal Question in Family Law in New York

estranged and living separately

I was told that since my parents have established separate residences and have been living apart for more than a year they are considered divorced in the eyes of the law. Is this true? Do they still need to file for divorce or legal separation?

No, that is not true. They must intiate legal action.
