I move to mnhathan in1996,until today,I have 1 child,10 yrs old.i find his father with the nanny on my house .he dont want the divoce and we dont have any agreement .

You may file for divorce based on adultery. You don't need his consent.

I am not really certain what your question is.
However, if you want a divorce and have the grounds (adultery is a grounds for divorce) the court will usually grant a divorce.
The court will divide your assets, determine custody, and provide support for the custodial parent.
