Legal Question in Family Law in New York

Giving my spouse money

My wife threw me out of my home 2 years ago. During that time I have been unable to get her to sign a legal separation agreement. We tried a mediator and while I had papers drafted and sent to her, she continually canceled appointments with the mediator over the course of the 2 years to sign the papers. I have been giving her $1000 a month (totaling $24000 in 2 years) to help with her rent while struggling myself to make ends meet in a separate household. As of this month I told her I was not going to pay her any more money until we worked out the divorce which I am now in the midst of filing on the grounds of constructive abandonement. She is now threatening to take me to family court to force child support with no discussion of getting the separation agreement. I have taken the money I had been giving her for this month and am using it to file papers using (whatever system you are using). What am I up against with this family court threat from her without a legal separation in place?

It seems that you can file for divorce already and settle all the issues through divorce, without waiting for your wife to sign papers.

You need to get help from a lawyer to help you with the process.
