housing

After being seperated for 14 months with nothing legal yet , can I force the sale of my house? She is in it and initiated the seperation ,I have a two year old daughter living with her.

You can secure a sale of the house only if you bring a divorce case to a successful conclusion and if that is the order of the court. The court will be concerned about what will happen to your wife and child and will need to be assured that your wife will be able to have a residence elsewhere. jeremy Morley

It depends if the house is soley in your name. File for custody of the child and file for divorce immediately.

Technically, you could bring an action for

partition Her response could be a counter

suit for separation and a request for exclusive

possession

The separation for 14 months at her insistence

is probably sufficient to argue grounds for

divorce File for divorce and have the

disposition of the house handled as part

of the equitable distribution
