Husband moves out not paying mortgage I cannot afford lawyer??

my husband left, I assume adultery, he is not paying mortgage I cannot afford lawyer he cashed his retirement plan - can he keep it and not split at when we get divorced?

It depends on what he used it for. If the money was spent to pay marital debt, the answer would be no. If the money was spent for the husband alone, it would be deemed a transferred asset and you would be entitled to equitable distribution.
