Legal Question in Family Law in New York

Invalid Divorce

I was married 12/99, to a person that I thought was legally divorced, But I found out there is no legal certified copy of a divorce for this person, in the nassau county court house, I think my spouse maried me, knowing that she was not legally divorce, She had a do-it- yourself divorce kit.

How can I find out if I have a legal marriage to this person.

Re: Invalid Divorce

If no judgment of divorce was signed- the marriage is void. You may have to commence an action annulling the declaring the void marriage.

Re: Invalid Divorce

If your wife was married to another at the time of your wedding, then your marriage is voidable. If she knew that she was still married, then your marriage was procured by fraud.

I practice in NYC and Long Island, but my office is across the street from the courthouse in Mineola.
