Legal Question in Family Law in New York

I have a joint custody order and i want to know if the other party does not deliver for a set holiday And states that they will bring them a day after the set holiday is that legal? Also, If they do bring the children after the holiday can i keep them in my custody because they breached the court order? Also, please not this would be their 4th Holiday Breech.
