Lawsuit against the other woman/man in an adultery divorce

I believe there is a law on the books, where the innocent spouse can file a lawsuit against the other woman/man?? I want to know under what grounds can this type of lawsuit take place? Which state does this apply? I live in New York and plan on filing in the same state. If New York state does have this law at what point can the suit take place (before, during or after the divorce?)

Please advise, your advice is greatly appreicated, thanks.

That is no longer the law in NY. It was called "alienation of affection" and can no longer be the basis of a lawsuit!
