Legal Question in Family Law in New York

lien on primary residence for child support

My husband is in arrears for child support b/c the amount that is paid from DFAS(Army) is the max percentage but not what the TN court requires for child support. We bought a house in NY( I am primary b/c it is my VA loan but he is on the loan as secondary). Can a lien be placed on our home and can we be forced to sell?

Re: lien on primary residence for child support

If his name ins on the deed a lien can be filed against the house but as you are married you cannot be forced to sell the property. When it is sold the amount will become due.

Can there be that much difference in the amount TN demands and the amount deducted? IS there a real problem in paying the difference? IT will come back and hurt more if it ends up being a large amount to pay.
