Legal Question in Family Law in New York

I live in NY my husband is verbally and mentally abusing me. I can not take it anymore. I moved into an apartment before we married he moved in a week later. His name was never on the lease and he never signed anything. I want him out and he will not leave. What means can I do to get him out? I will not leave this is my home and I don't have any friends or family willing to take me in.

He has hit me in the past... he is an alcoholic. He stinks and lives on the couch day in and day out. Please answer soon! Thank you!

No one, NO ONE should be mentally or physically abused. You can file for an Order of Protection in the Family Court. If he ever hits you, you may contact the police. The District Attorney would file an Order of Protection on your behalf.
