Legal Question in Family Law in New York

Non custodial parent w/ no visitation rights wants to see child

My ex has had no contact w/ my 3year old son since he was born. In a custody hearing he made itkonwn to the court that he had no want or intention of visitation w/ his son. He turned down visitation offered by myself and the courts. He now claims to want to see my child. He has a record of alcoholism and serious drug abuse. Do I have to allow my child to see him? Also, the paternal grandmother wants to take my child on an ''outing'' but I am afraid she'll take my son to see his father, as his father now lives with her. Can I only allow them to visit in my home while I am present?

If the judgment mentions nothing about visitation, you do not have to allow the father to visit with the child. The father can petition the court on his own for visitation should he choose to do so. You also do not need to allow the grandmother to visit if you do not wish to do so. Good luck. Feel free to email me with any further questions.
