Legal Question in Family Law in New York

order of protection,

parents share custody of 2 minor teens. Mom is alcoholic and lives with alcoholic(who was in jail for various dwi's and alcohol related things). Mom and boyfriend get drunk verbally abuse children and boyfriend got physicial with 16yr old son, can Dad (other parent) get an order of protection for while kids are there

Re: order of protection,

Yes. The dad on behalf of the child may apply for an Order of Protection against the boyfriend. I would also suggest that the child is physically with the dad when he makes the application since he will be questioned by the Judge.
