Legal Question in Family Law in New York

Phone calls to children.

My wife and I do not live together and we have a joint custody agreement where we each have the two children(ages 5 and 6) every other week. On the week I have them y wife calls to see how their day was or to say good night and I do the same when she has them. since we went to court about child support and she found out she may not be entitled to any she will only allow me to speak to my children on speakerphone. She lives with her parents, it's loud and everyone in the room is included in my conversation with my children. Don't I have the right to speak to my children or say good night privately? any help would be greatly appreciated.

Go back to family court and file a petition to modify the visitation order explaining that you fell that this is a violation of your ability to have a relationship with your children. Be prepared for a cheap shot in return to claim that she needs to monitor your communications with your children for some reason. I truly recommend that you do not attempt this without legal assistance. This can get ugly and you need a person with experience and a cool head.
