Legal Question in Family Law in New York

Sole Custody and Travelling

Hi,

I have sole custody of my 2yr old son and is allowed to travel with him and his father has weekends visitation. The courts ordered him to sign all the necessary paper work to get my son passport and he is refusing to do so. My question to you is A) Can i apply for the passport without him since i have sole custody? Or B) Do I have to take him back to court for not following the court orders.

How do i go about getting my son passport without involving my father in the process unless i have to?

any help will be greatly appreciated

Thanks

Re: Sole Custody and Travelling

I would first go to the agency that processes passports and see if his signature is required. If not - since you have sole custody- it solves the problem. If you need his signature, and the father refuses, take him back to court - and don't forget to ask for your legal fees to be paid by him.
