Can my wife take my children out of new york to live in onother state without my consent?

The mother may not infringe on your rights to visit the children. The Court looks toward the best interest of the children. Therefore, the mother would have to file a petition with Family Court if she is to move outside New York. The petition may or may not be granted after the Court reviews how the move will impact the children.
